LABOUR LAW

LAW FIRM FOR LABOUR LAW IN DÜSSELDORF: PETERS Rechtsanwälte

Labour law is one of our core competencies. With many years of practice, we are particularly well experienced in this area. We at PETERS Rechtsanwälte will assist you in all fields of labour law - out of court and in all labour courts throughout Germany.

INDIVIDUAL LABOUR LAW: MANAGING RELATIONS BETWEEN EMPLOYEE AND EMPLOYER

Individual labour law is an important part of labour law and regulates claims which concern the individual employment relationship. The majority of disputes under individual labour law concern the employment relationship and predominantly include questions regarding the employment contract, the implementation of the employment relationship and its termination. We advise employers and employees on drafts, reviews, and amendments of employment contracts and on employment references. We draft termination and settlement agreements, calculate and negotiate severance payments in the context of dismissals, we pursue actions for protection against dismissal on behalf of employees and we support employers and employees in out-of-court settlements of labour law disputes.

For employees, legal action for protection against dismissal is often the last resort to save the job or to receive compensation for the dismissal. This requies quick action as the action for protection against dismissal must be received by the labour court within three weeks of receipt of the notice of termination. If this deadline is missed, the dismissal is considered effective, even if it has formal or substantive defects. At PETERS Rechtsanwälte you will receive prompt legal support in order to solve your problem in your favour as quickly as possible.

MANAGERS AND EXECUTIVES

One focus of our activities is the preparation and negotiation of contracts for CEOs and managing directors. Careful drafting of employment contracts helps to avoid disputes. Equally important is the protection against liability cases through appropriate D&O insurance policies. If a working relationship ends at prematurely or not amicably, we ensure that your legal and financial interests are protected. For people with exposed positions that rely on their reputation, it is crucial to be able to receive confidential and reliable advice. We can guarantee this because of our many years of experience.

COLLECTIVE LABOUR LAW: COLLECTIVE BARGAINING LAW AND WORKS CONSTITUTION LAW

Another focus of the labour law department at PETERS Rechtsanwälte is collective labour law. This area primarily deals with questions of collective bargaining law and works constitution law. It regulates relations between the employer and representative councils of the employees such as works councils, staff councils, or trade unions. Therefore, individual employees are not directly addressed in collective labour law. Together with companies, we update and develop compensation models, for example in the context of collective labour law advice, and help with their implementation. We also negotiate with works councils, staff councils, or trade unions. Furthermore, we advise on participation rights of employees in business and entrepreneurial decisions (for example, under the German Co-Determination Act) and, in special situations, we help to find mutually acceptable and justifiable regulations without the risk of litigation or recourse.

CONSULTING AND REPRESENTATION OF WORKS COUNCILS

A works council is an institutionalised employee representation in companies, businesses, and company groups. The aim is to assert the interests of the employees vis-à-vis the employer and to ensure that all labour law standards and regulations are observed in the company. PETERS Rechtsanwälte specialises in the entire field of works constitution law and advises works councils, for example in cases of violation of information and notification obligations by the employer, in the support and defence of restructuring measures that have not been approved by the employee representatives, or in dealing with personnel measures without involvement of the works council.

LABOUR LAW FOR MANAGERS AND EXECUTIVES

A traditional focus of our labour law and commercial law practice is the preparation and negotiation of contracts for management board members, managing directors and CEOs. The careful drafting of employment contracts can avoid many disputes, in particular with regard to compensation and bonus agreements, periods of notice, non-competition clauses, and other issues essential to executives. If a working relationship ends prematurely or even by mutual agreement, we ensure that your legal and financial interests are protected. Exposed positions and reliance on a good reputation require confidential handling and reliable advice. Thanks to our many years of experience we will be by your side even in tough times. It is equally important to protect against liability cases by means of appropriate D&O insurance or the contractual arrangement of far-reaching liability restrictions. We provide labour law services for managers and executives in mid-tier companies as well as in international corporations. Due to our extensive expertise in individual labour law at board and managing director level, we advise boards, managers, and executives across all industries.

INTERNATIONAL LABOUR LAW

The labour law frameworks in various European countries strongly differ in some aspects. On the basis of our long-standing and well-established network with partner law firms in several European countries, we are able to guarantee ideal support in cross-border labour law issues. Due to the increasing internationalisation of the economy, especially in the European Union, employers and employees are regularly challenged to develop labour law solutions for permanent or temporary foreign assignments. In international legal relations, employers need to consider labour law issues in transactions, restructurings, in the establishment of distribution systems, and other entrepreneurial activities. At PETERS Rechtsanwälte, we have been supporting our clients in these areas for many years. Especially thanks to the expertise of our Japan Desk, we are able to manage labour law relations between German and Japanese contractual partners and, of course, to advise Japanese citizens in Germany on individual labour law issues in their mother tongue.
