INDIVIDUAL LABOUR LAW: MANAGING RELATIONS BETWEEN EMPLOYEE AND EMPLOYER

Individual labour law is an important part of labour law and regulates claims which concern the individual employment relationship. The majority of disputes under individual labour law concern the employment relationship and predominantly include questions regarding the employment contract, the implementation of the employment relationship and its termination. We advise employers and employees on drafts, reviews, and amendments of employment contracts and on employment references. We draft termination and settlement agreements, calculate and negotiate severance payments in the context of dismissals, we pursue actions for protection against dismissal on behalf of employees and we support employers and employees in out-of-court settlements of labour law disputes.

For employees, legal action for protection against dismissal is often the last resort to save the job or to receive compensation for the dismissal. This requies quick action as the action for protection against dismissal must be received by the labour court within three weeks of receipt of the notice of termination. If this deadline is missed, the dismissal is considered effective, even if it has formal or substantive defects. COLLECTIVE LABOUR LAW: COLLECTIVE BARGAINING LAW AND WORKS CONSTITUTION LAW

Another focus of the labour law department at PETERS Rechtsanwälte is collective labour law. This area primarily deals with questions of collective bargaining law and works constitution law. It regulates relations between the employer and representative councils of the employees such as works councils, staff councils, or trade unions. Therefore, individual employees are not directly addressed in collective labour law. Together with companies, we update and develop compensation models, for example in the context of collective labour law advice, and help with their implementation. We also negotiate with works councils, staff councils, or trade unions. Furthermore, we advise on participation rights of employees in business and entrepreneurial decisions (for example, under the German Co-Determination Act) and, in special situations, we help to find mutually acceptable and justifiable regulations without the risk of litigation or recourse.

CONSULTING AND REPRESENTATION OF WORKS COUNCILS

A works council is an institutionalised employee representation in companies, businesses, and company groups. The aim is to assert the interests of the employees vis-à-vis the employer and to ensure that all labour law standards and regulations are observed in the company. PETERS Rechtsanwälte specialises in the entire field of works constitution law and advises works councils, for example in cases of violation of information and notification obligations by the employer, in the support and defence of restructuring measures that have not been approved by the employee representatives, or in dealing with personnel measures without involvement of the works council.
