  • disclosure is necessary for the assertion, exercise or defense of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data (Art. 6 para. 1 sentence 1 lit. f GDPR).

5. cookies and analysis tool

We use cookies on our website. These are small files that your browser automatically creates and that are stored on your end device (smartphone, tablet, laptop, etc.) when you visit our website. Cookies do not cause any damage to your end device and do not contain any viruses, Trojans or other malware.

The cookie stores information related to the specific device being used. However, this does not mean that we can directly identify you.

The main purpose of using cookies is to make the use of our website more convenient for you. For example, we use so-called “session cookies” to recognize that you have already visited individual pages of our website. These cookies are automatically deleted after you leave our site.

In addition, we also use temporary cookies to optimize user-friendliness and these are stored on your end device for a specified period of time. When you revisit our website to use our services, we automatically recognize that you have been here before and recall your previous inputs and settings. You will not have to enter these again.

On the other hand, we use cookies to statistically record the use of our website and to evaluate it for the purpose of optimizing our offer for you. When you visit our website again, these cookies enable us to automatically recognize that you have already visited us and which information was of particular interest to you. The corresponding cookies are automatically deleted after a defined period of time.

The data processed by cookies are necessary for the purposes mentioned to protect our legitimate interests and the interests of third parties (Art. 6 para. 1 sentence 1 lit. f GDPR).

Most browsers accept cookies automatically. However, you can also configure your browser so that no cookies are stored on your computer or a message always appears before a new cookie is created.

Most browsers accept cookies automatically. However, you can also configure your browser so that no cookies are stored on your computer or a message always appears before a new cookie is created.

We also use a web analysis service. This is software that serves to optimize the website and also uses cookies to anonymously evaluate visitor access to our website. The information generated by the cookies about your use of this website is not used for personal evaluation or profiling and is also not passed on to third parties. The analysis serves exclusively to optimize our offer.

If you use a browser extension that blocks advertising content and tracking services, i.e. a so-called ad blocker or tracking blocker, or if you use a privacy setting in your browser that prevents the storage of our cookies, we will of course respect this and will not make any attempts to disguise the use of the analysis service on our site or otherwise hinder the functioning of your program. In this case, cookies are not stored and the use of this website is not tracked. However, further information fields on the use of cookies may not be displayed or may not be displayed correctly due to your settings.

If you do not use an advertising or tracking blocker or have not configured a no-cookie preference, but you still do not consent to the storage and anonymous evaluation of the data from your visit to our website, you can object to the storage and use at any time. If you subsequently click to object to the processing of the data, an opt-out cookie will be stored in your browser, which means that our web analysis service will not collect any session data. If you delete your cookies in your Internet browser, the opt-out cookie will of course also be deleted. It must therefore be reactivated when you visit our website again.

6. social media

We take the current discussion about data protection in social networks very seriously. It is currently not legally clear whether and to what extent all networks offer their services in accordance with European data protection regulations.

We therefore expressly point out that the services we use (currently LinkedIn) store their users’ data (e.g. personal information, IP address) in accordance with their own data usage guidelines and use it for business purposes.

We have no influence on the collection of data and its further use by the social networks. For example, we have no knowledge of the extent to which, where and for how long the data is stored, to what extent the networks comply with existing deletion obligations, what evaluations and links are made with the data and to whom the data is passed on.

7. use of data for scientific purposes

We also offer you legal-academic content on our website, for example by reporting on current legislative projects, the course of discussions and resolutions of the statutory assembly and current (supreme) court decisions.

Personal data is processed exclusively in anonymized form or, if the latter is not possible, in pseudonymized form (Section 28 (1) DSG NRW).

If you have any questions (or suggestions), please contact info@peters-legal.com.

8. protection of minors

Persons under the age of 18 should not transmit any personal data to us without the consent of their parents or legal guardians.

We do not request personal data from children and young people. We do not knowingly collect such data and do not pass it on to third parties.

9. rights of data subjects

You have the right,

  • pursuant to Art. 7 (3) GDPR to withdraw your consent at any time. Withdrawal of consent does not affect the lawfulness of processing based on your previous consent. The only consequence of withdrawal is that we will no longer continue processing your data on that basis in the future.
  • pursuant to Art. 15 GDPR to request information about your personal data processed by us. In particular, you can request information about
    • the purposes of processing
    • the categories of personal data that are or have been processed

    • the planned storage period
    • the existence of a right to rectification, erasure or restriction of processing or a right to object
    • the existence of a right to lodge a complaint with a supervisory authority
    • the origin of your data if it was not collected by us
    • the existence of automated decision-making, including profiling and, where applicable, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for you.
  • in accordance with Art. 16 GDPR, to immediately request the rectification of incorrect personal data concerning you or the completion of your personal data stored by us if it is incomplete
  • to request the erasure of your personal data stored by us in accordance with Art. 17 GDPR. This does not apply if the processing of your data is necessary
    • to exercise the right to freedom of expression and information
    • to fulfill a legal obligation
    • for reasons of public interest in the area of public health
    • for archiving purposes in the public interest, scientific or historical research purposes or for statistical purposes
    • for the assertion, exercise or defense of legal claims.
  • pursuant to Art. 18 GDPR to demand the restriction of the processing of your personal data. This applies insofar as
    • the accuracy of the data is disputed by you
    • the processing is unlawful, but you oppose the erasure of the data and request the restriction of their use instead
    • we no longer need the data, but you need the data to assert, exercise or defend legal claims
    • you have objected to the processing pursuant to Art. 21 (1) GDPR
  • in accordance with Art. 20 GDPR, to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format or to request that it be transmitted to another controller
  • pursuant to Art. 77 GDPR to lodge a complaint with a supervisory authority. As a rule, you can contact the supervisory authority at your usual place of residence or workplace or at the registered office of our law firm.

You can tell whether an individual page of our website is transmitted in encrypted form by the closed display of the key or lock symbol in the lower status bar of your browser. We assume no responsibility for the collection and processing of data by third parties.

You can recognize third-party websites by the fact that they always open in a separate window of your browser. In contrast, new websites of our offer always open in a new tab of your browser.

13. Regular updating of this data protection notice

The data protection framework for service providers is subject to constant changes and adjustments. These changes and adjustments make it necessary to update our data protection information from time to time.

You can recognize the current status by the line “Status: …” at the end of this data protection notice.

14. Google reCAPTCHA

Our website, www.peters-legal.com, uses Google reCAPTCHA for data security reasons to protect personalized access, such as our contact form, against automated access attempts (e.g. by so-called bots).

Google reCAPTCHA is a service provided by Google LLC, Gordon House, Barrow Street, Dublin 4, Ireland, hereinafter referred to as “Google”.

When using this service, Google can determine from which website a request is sent and from which IP address the so-called reCAPTCHA input box is used. In addition to the IP address, Google may also collect other information that is necessary for the offer and provision of this service, which may include

  • the language set in the browser,
  • screen and window resolution,
  • time zone and
  • installation of browser plug-ins.

The legal basis for data processing is Art. 6 para. 1 lit. f) GDPR. Accordingly, data processing is lawful if it is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data. Our overriding legitimate interest lies in the security of our website and our customers and in preventing unauthorized, automated access attempts.

In order to be able to use reCAPTCHA, Google checks whether a cookie has already been created in the user’s browser. If this is not the case, Google creates a cookie. Google creates a fingerprint of the user for reCAPTCHA, which is also recognized on other pages. This enables Google to determine whether the user is a human or a machine.

Please note that if you deactivate JavaScript, you will not be able to use the services that are secured by Google reCAPTCHA.

At https://policies.google.com/privacy Google offers further information on the general handling of your user data.

Further information on the legal framework for data transfers can be found at https://policies.google.com/privacy/frameworks.
